1. Acceptance of Terms

By accessing or using the ForgeOS platform and services provided by New Forge Tech ("Company"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Services

ForgeOS is an AI-native Manufacturing Operations Management (MOM) platform that provides manufacturing execution, quality management, traceability, remote support, and related services. Services are provided on a subscription basis as defined in your service agreement.

3. User Accounts

When you create an account, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access
  • Accept responsibility for all activities under your account

4. Acceptable Use

You agree not to:

  • Use the services for any unlawful purpose
  • Attempt to gain unauthorized access to any systems
  • Interfere with the proper functioning of the services
  • Reverse engineer or attempt to extract source code
  • Resell or redistribute the services without authorization

5. Intellectual Property

ForgeOS, its features, functionality, and all related intellectual property are owned by New Forge Tech. Your use of our services does not grant you any ownership rights. You retain ownership of your data and any content you create using our platform.

6. Data and Privacy

Your use of ForgeOS is also governed by our Privacy Policy. You retain ownership of your manufacturing data. We process your data only as necessary to provide the services and as described in our privacy policy.

7. Service Availability

We strive to maintain 99.9% uptime for our cloud services. However, we do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance. For on-premise and air-gapped deployments, availability depends on your infrastructure.

8. Limitation of Liability

To the maximum extent permitted by law, New Forge Tech shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the services. Our total liability shall not exceed the amount paid by you in the twelve months preceding the claim.

9. Modifications

We reserve the right to modify these terms at any time. Material changes will be communicated via email or through the platform. Continued use after changes constitutes acceptance of the modified terms.

10. Governing Law

These terms shall be governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
